No healthcare provider-patient relationship, physician-patient relationship, or therapeutic relationship of any kind is created, established, or implied by your use of this website or any services offered through it. Group Sessions, Workshops, and Community Programs
RoseWell Health may offer group sessions, workshops, webinars, and community programs, whether in person or online, for educational and wellness purposes only. By registering for or participating in any such session or program, you acknowledge and agree that:
No healthcare provider-patient relationship, physician-patient relationship, or therapeutic relationship of any kind is created, established, or implied by your registration for or participation in any group session, workshop, webinar, or community program;
All content delivered in connection with any group session, workshop, webinar, or community program is for general educational and wellness purposes only and is not intended to be, and must not be used as, a substitute for professional medical advice, diagnosis, or treatment;
(iii) No individualized diagnosis, treatment plan, or prescription will be provided during any group session, workshop, webinar, or community program, regardless of any questions asked or information shared by any participant during the session;
(iv) All materials, presentations, recordings, and resources shared in connection with any group session, workshop, webinar, or community program are subject to the intellectual property protections set out above in this Section 2. You may not record, reproduce, share, redistribute, upload, post, or otherwise make available to any third party any such materials, in whole or in part, in any format or by any means, without the prior written permission of RoseWell Health; and
(v) Attendance at or participation in any group session, workshop, webinar, or community program does not create eligibility for MSP billing or entitlement to private clinical services.
Full terms and conditions applicable to specific group sessions, workshops, webinars, or community programs will be provided to you in a separate Group Session Agreement at the time of enrollment.
3. Accessibility

RoseWell Health reserves the right to refuse service or terminate access to this website for any user who provides false information regarding their age or parental consent.
6. Appointment Booking and Third Party Online Services
(a) Third Party Services
This website may provide links to third-party online services, including but not limited to Jane App, for appointment booking, patient management, and related healthcare services. These third-party services are not owned, operated, or controlled by RoseWell Health.When you access or use any third-party service through a link on this website, you acknowledge and agree that:
(i) You are leaving the RoseWell Health website and accessing a separate platform operated by a third party;
(ii) Your use of any third-party service is subject to that third party's separate terms of use, privacy policy, and other policies, which you should review carefully;
(iii) You are responsible for ensuring the accuracy and completeness of any information you submit to third-party services;
(iv) RoseWell Health makes no representations or warranties regarding the availability, functionality, security, accuracy, or reliability of any third-party services;
RoseWell Health is not responsible for the privacy practices, data security, or content of third-party services, service interruptions, or unauthorized access to your information through such third-party services.
RoseWell Health reserves the right to add, modify, or remove links to third-party services at any time without prior notice.
(b) Consent Requirement for Appointment Booking
If you choose to book an appointment with RoseWell Health through a third-party service such as Jane App, you will be required to affirmatively acknowledge and confirm your acceptance of these Terms and our Privacy Policy by checking a confirmation box or providing other explicit consent before your appointment can be scheduled or proceed. This affirmative confirmation is required as part of the third-party booking service.By providing such affirmative consent, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy in connection with any healthcare services, appointments, or patient relationship with RoseWell Health. Your failure to provide such consent will prevent you from booking or attending appointments through RoseWell Health.

7. Healthcare Services, Fees, and Policies
RoseWell Health care visits and programs are voluntary and provided on a private-pay basis. RoseWell Health does not operate as a primary care clinic, and these Terms govern your use of this website only and do not constitute an agreement for healthcare services. If any medically necessary services arise from your care, such as prescriptions or laboratory requisitions, these will be provided where eligible for coverage under the British Columbia Medical Services Plan ("MSP"). RoseWell Health encourages you to maintain access to insured primary care services through your primary care provider or walk-in clinic. Some services provided by RoseWell Health may be eligible for MSP coverage depending on your individual eligibility and the nature of the services received. However, not all services offered by RoseWell Health are covered by MSP, and certain services, including but not limited to educational programs, courses, workshops, and group sessions, are provided on a private-pay basis only, regardless of MSP eligibility. MSP eligibility is patient-specific, subject to change, and will be assessed at the time of booking or service delivery. You are responsible for confirming your MSP eligibility with the relevant authorities. Full details regarding applicable fees, payment terms, and MSP or private billing arrangements will be provided to you in the separate service agreement at the time of booking.
(a) Cancellation and No-Show Policy
Appointments are subject to RoseWell Health's cancellation and no-show policy, which requires advance notice of cancellations and may impose fees for late cancellations or missed appointments. The full cancellation policy will be provided to you at the time of booking. Repeated failures to provide adequate cancellation notice or attend scheduled appointments may result in refusal of future bookings.
(b) Separate Service Agreement
When you book an appointment through a third-party service such as Jane App or directly with RoseWell Health, you will enter into a separate agreement governing:
Service fees and payment terms; Cancellation and rescheduling policies; Refund policies (if applicable); Patient responsibilities and consent to treatment.
You are responsible for reviewing and agreeing to all applicable fees, policies, and terms prior to booking or receiving services. All fees and policies will be disclosed to you through the booking process or prior to service delivery.
Future Service Offerings
RoseWell Health reserves the right to introduce new service models not otherwise addressed in these Terms, including subscription-based care or membership programs, which will be governed by separate terms and conditions provided to you at the time of enrollment.
8. Additional Terms
(a) Telehealth Services: If you participate in telehealth or virtual care appointments, you will be required to review and consent to our separate Telehealth Consent and Policy. RoseWell Health reserves the right to require in-person assessment when clinically necessary.
(b) User Generated Content: If you submit reviews, comments, or other content ("UserContent") to this website, you grant us a worldwide, non-exclusive, royalty-free, perpetual right to use, reproduce, modify, and display such content for any business purpose. You represent that your User Content is accurate, lawful, and does not violate third-party rights. We may monitor, edit, or remove User Content at our sole discretion without notice and are not responsible for its accuracy. To report problematic content, contact info@rosewellhealth.ca.
(c) Cookies and Tracking: This website uses cookies and tracking technologies for functionality, analytics, and marketing purposes. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RoseWell Health, its affiliates, directors, officers, employees, agents, contractors, licensors, and representatives will not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to personal injury, loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with: (i) your use of, or inability to use, this website; (ii) any information, content, or materials obtained through this website; (iii) unauthorized access to or alteration of your transmissions or data; or (iv) any other matter relating to this website, even if we have been advised of the possibility of such damages. Any false, inaccurate, or misleading information you provide to RoseWell Health;
Your failure to obtain necessary consents or provide accurate medical or personal information in connection with healthcare services.
This indemnification obligation will survive the termination of your use of this website.
12. Force Majeure
RoseWell Health is not liable for any delay, failure, or interruption in website performance or service delivery caused by events beyond our reasonable control, including but not limited to: internet or telecommunications outages; pandemics or public health emergencies; strikes or labor disputes; or power failures. Our performance obligations are suspended during such events.
13. Dispute Resolution
Before commencing any legal action, you agree to first attempt to resolve any dispute informally by contacting us at info@rosewellhealth.ca with a detailed description of the dispute. If the dispute cannot be resolved informally within 30 days, you agree to participate in good faith mediation before a mutually agreed mediator in Vancouver, British Columbia. Each party will bear its own costs of mediation, and the settlement terms are strictly confidential. This requirement does not apply to claims for urgent injunctive relief or disputes within the jurisdiction of the BC Small Claims Court. Nothing in this section prevents either party from seeking such relief when necessary.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the province of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to principles of conflicts of law. You irrevocably agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, for the resolution of any disputes arising from or relating to your use of this website or these Terms, and you waive any objection to venue or inconvenient forum in such courts.If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.

We will provide notices to you by email at the address you provided during registration or booking, or by posting on this website. Notices sent by email are deemed received 48 hours after sending (excluding weekends and statutory holidays). Notices posted on the website are deemed received immediately upon posting. You are responsible for keeping your contact information current.
17. Changes to the Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 14 days' prior notice by posting the updated Terms on this page and, where practicable, notifying you by email. The updated Terms will be posted on this page with a new effective date. Your continued use of the website after the effective date of any changes constitutes your acceptance of the updated Terms.
